Florida Lawyer Challenges Trump’s Right to Run For President- Is Anyone Surprised?

Former president Donald Trump has consistently claimed that the indictments were part of a witch hunt. He has also labeled them as election interference. His claims were proven true on August 24, 2023.

An attorney from Florida has done exactly what the Democrats wanted someone to do in secret. Last week, Lawrence Caplan, a lawyer from Florida, lodged a challenge in federal court, contending that ex-President Donald Trump’s candidacy for President infringes upon the 14th Amendment. The origin of the clause used in this legal challenge can be traced back to the Civil War.

Does this development astonish anyone? This objective has been the focal point of the Biden administration since the inauguration of Joe Biden. Their strategy involves eliminating competition by incarcerating opponents and ensuring their disqualification from future runs for the Oval Office. The intentions behind the challenge are not concealed either. Caplan merely needed to refer to a clause in the Amendment stipulating that individuals who have engaged in insurrection or rebellion against the government are ineligible for holding office. This was the point of the January 6 Committee.

Then, there was the latest indictment charge brought by Fani Willis. According to Georgia law, the act of inciting an insurrection involves encouraging others to overthrow the government and committing a violent act to support it. Willis has made accusations against former President Trump and 18 other individuals for allegedly orchestrating a criminal scheme to overturn the results of the 2020 Georgia election, which would result in the government being overthrown.

Given the perception that the Department of Justice is being weaponized against conservative Republicans, it seems unlikely that Trump will receive a fair trial. However, even if the DOJ were not being weaponized, the prospect of a fair trial for Trump remains uncertain. Donald Trump is a prominent public figure known worldwide, and the likelihood of finding someone in the United States who does not know anything about Trump is slim to none. Potential jurors are likely to be influenced before the trial even commences.

One must also consider if “innocent until proven guilty” applies to Donald Trump. This principle is the foundation of the American justice system. While many accusations and allegations have been made against Trump, it is important to remember that he has not been convicted of any crimes. Therefore, he should be presumed innocent until proven guilty, like any other citizen.

Even though Trump has yet to be found guilty of these crimes, the foundation of this lawsuit rests on Caplan’s assertion that President Trump actively participated in an insurrection and provided support to others involved in the Capitol riot on January 6, 2021. Caplan highlights that “Trump’s efforts both in Washington, as well as in Georgia, and perhaps other states, as well as the consequential assault on the US Capitol, put Trump at the center of the disqualification clause.”

Caplan believes that his stance aligns with Section Three of the 14th Amendment. Caplan explains, “Assuming that the public record to date is accurate, and we have no evidence to the contrary, Trump is no longer eligible to seek the office of the President of the United States, or of any other state of the Union.”

Alan Dershowitz, a Harvard Law School Professor Emeritus, has voiced reservations about the premise that Trump’s candidacy is prohibited by the 14th Amendment, deeming it a “serious threat” to the Constitution. Dershowitz stated in an interview on the “Just the News, No Noise” television program that the determination of the President’s identity would shift from the hands of the people to the purview of local Secretaries of State and Democratic governors.

He is not alone in expressing apprehensions about disqualifying Trump from running. Do the Democrats have grounds to fear Trump? The answer appears affirmative. Let’s consider the recent mug shot posted on Trump’s account on X (formerly known as Twitter). Elon Musk deemed that tweet “next-level,” signifying it garnered more traction than any other tweet posted since Musk assumed control. It seems that Trump is taking advantage of the current media buzz. Posting his mugshot was nothing short of genius. The internet is abuzz with the abundance of fake mugshot memes, strengthening Trump’s stance.

No matter what the Democrats do, Trump supporters remain loyal. At present, Trump unmistakably leads the GOP nomination race for President by a substantial margin in most polls, indicating robust support for Trump and skepticism toward the narrative propagated by the Biden Administration.
