Man Indicted for Murder in Shooting of 9-Year-Old Girl in Harris County

HARRIS COUNTY, Texas – A 33-year-old man faces a murder indictment after the tragic shooting of 9-year-old Arlene Alvarez in the Gulfgate area in 2022, as announced by the Harris County District Attorney’s Office. The incident, which occurred on Valentine’s Day while Arlene and her family were on their way to get pizza, has left the community in shock.

Tony Earls Jr. found himself at the Chase Bank in the Winkler and Woodridge intersection when he was reportedly robbed at gunpoint around 9:30 p.m. In an attempt to defend himself, Earls fired at the fleeing robber. Tragically, Arlene’s family was passing by the bank in their pickup truck at that very moment, and Earls fired several shots into the vehicle, resulting in the young girl’s death.

Following the initial arrest and aggravated assault charge, the grand jury declined to indict Earls in July 2022, leading to his release. However, two months ago, the Harris County District Attorney’s Office appointed a special prosecutor to reassess the case, leading to the current indictment. The special prosecutor asserted that Earls had a clear line of sight and no justification to shoot into the passing vehicle with Arlene inside.

According to special prosecutor Warren Diepraam, an expert’s opinion indicates that Earls witnessed the robber running past the Alvarez family’s truck and acted without proper cause. Investigations are ongoing to identify and apprehend the robber involved in the initial incident. If convicted of murder, Earls could face a wide range of penalties, extending from five years in prison to a life sentence.
