Judge Locks Up Suspect Accused Of Shooting Stranger In The Back

ORANGE CITY, Fla. — A 21-year-old man accused of shooting a stranger outside an Orange City shopping plaza will remain jailed after a judge denied bond Monday in a Volusia County aggravated battery case.

Joseph Aviles is accused in a Saturday morning shooting that injured one man near an Ollie’s Bargain Outlet. Police said the case began as a verbal dispute between two people who did not know each other and ended when shots were fired from a vehicle.

Investigators said Aviles approached the victim outside the store and made a comment that led to an argument. The confrontation appeared to be ending when Aviles got into a vehicle. Police said he then fired three shots from the passenger seat, striking the victim twice in the back.

The victim underwent surgery and is expected to survive. An arrest report said witnesses told investigators Aviles and a woman who was driving left the scene after the shooting. Police later found the woman, who has been cooperating with the investigation.

Authorities said the woman’s young son was in the vehicle at the time. Police said the two had been shopping for items for the child’s fourth birthday party. No charges had been filed against the woman as of Monday night, and investigators had not announced any additional arrests.

Aviles’ attorney asked the court to set bond at $150,000 with conditions, including no contact with the victim and no access to firearms. The judge denied the request, citing the seriousness of the allegations and the use of a firearm.

The case now moves forward with Aviles in custody. He faces an aggravated battery charge and is scheduled to return to court next week. Police have not released the victim’s name, and the exact words that started the argument remain part of the investigation.

As of Tuesday, Aviles remained jailed without bond while the victim continued recovering from surgery. The next known milestone in the case is Aviles’ court appearance next week.
