Deputies say the delivery worker returned to a Southwest Miami-Dade apartment complex after an earlier delivery and was confronted at gunpoint.
MIAMI, Fla. — A 33-year-old man faces an attempted felony murder charge after authorities said he shot and struck an Uber Eats driver who had returned to a Southwest Miami-Dade apartment complex after meeting the man’s girlfriend during a food delivery.
Miami-Dade Sheriff’s Office investigators identified the accused man as Khuslen Saruultuya. According to an arrest report, the driver first met the woman while making a delivery at Pearl Dadeland Apartments early Monday. The two spoke briefly outside the building’s main lobby. Investigators said the driver later returned to the complex because he hoped to see the woman again and possibly get her phone number.
The arrest report places the first encounter at about 2:35 a.m. and the driver’s return at about 3:25 a.m. The driver was heading back toward his vehicle after failing to find the woman when Saruultuya allegedly arrived in a gray Chevrolet Corvette. Deputies said Saruultuya got out, pointed a handgun at the driver and ordered him to get on the ground.
Authorities allege Saruultuya fired a shot that grazed the driver’s buttock after the driver complied. Investigators said Saruultuya then struck the driver on the back of the head with the handgun, causing another injury. Deputies further allege that Saruultuya pointed the weapon at the driver’s head and threatened to kill him. The woman tried to intervene as the confrontation continued, according to the arrest report.
The driver was ultimately able to get away and drove himself to South Miami Hospital for treatment. A sheriff’s deputy had responded to the apartment complex at about 3:34 a.m. after a report of gunfire. Investigators said a witness described an altercation involving an armed man who then left in a two-door sports car. A police officer working at the hospital also alerted authorities after the injured driver arrived for treatment.
Deputies said investigators traced the Corvette described by the witness to Saruultuya. Authorities also said the driver later identified Saruultuya in a photo lineup. Deputies arrested Saruultuya at his Southwest Miami-Dade residence Monday evening without incident and took him to the Turner Guilford Knight Correctional Center.
Saruultuya faces attempted felony murder and aggravated battery with a deadly weapon charges stemming from the confrontation. The charges are allegations, and the filing of a criminal charge does not establish guilt. Reporting reviewed Wednesday showed Saruultuya remained in county custody, while his criminal cases continued through the Miami-Dade court system.
The arrest also led to a separate investigation after deputies searched Saruultuya’s residence and reported finding suspected controlled substances, prescription pills and cash. Those findings resulted in additional drug-related charges that are being handled separately from the allegations involving the delivery driver.
Uber said in a statement reported by Local 10 that it was reviewing the incident and would cooperate with law enforcement. Authorities have not publicly identified the delivery driver in the reports reviewed, and no final determination has been made on the criminal allegations against Saruultuya.
