Alleged Affair Dispute Turns Deadly in Buford Highway Shooting

Police said officers detained a man shortly after gunfire erupted outside a restaurant along Buford Highway early Sunday.

DORAVILLE, Ga. — A man was killed and two restaurant patrons were injured by shattered glass after gunfire erupted along Buford Highway around midnight Sunday, according to Doraville police, who detained a suspect as officers responded to the area.

Police identified the man who died as Pablo Gutierrez-Gallegos and the detained suspect as Daniel Roman-Cortez. Investigators said officers responding to reports of gunfire in the 5700 block of Buford Highway saw a blue pickup truck attempting to leave the area. Officers stopped the truck and took Roman-Cortez into custody. He remained in police custody as the investigation continued.

Investigators said Roman-Cortez made statements to officers acknowledging responsibility for the shooting during the traffic stop. Police have described the killing as stemming from a personal dispute and said Roman-Cortez told investigators that he believed Gutierrez-Gallegos was involved in an affair with his wife. Authorities have not independently established that allegation, and the reported dispute remains part of the investigation.

Officers later found Gutierrez-Gallegos unresponsive on the pavement outside a restaurant in the 5800 block of Buford Highway. Police attempted lifesaving measures before DeKalb County paramedics arrived. Gutierrez-Gallegos was pronounced dead at the scene, according to police accounts released after the shooting.

The gunfire also damaged the restaurant and shattered glass inside the business. Two people who had been sitting inside were struck by flying glass fragments. Emergency medical personnel evaluated both patrons at the scene and determined that they did not have serious injuries requiring further emergency treatment, according to police.

The sequence described by investigators places the initial reports of gunfire in the 5700 block and the discovery of Gutierrez-Gallegos near a restaurant in the 5800 block. Police have not publicly confirmed the name of the business in their accounts of the shooting. Separate local reporting identified a possible restaurant, but authorities had not confirmed that detail in the police information reviewed Monday.

The Georgia Bureau of Investigation is assisting Doraville police as investigators process evidence and examine the circumstances surrounding the shooting. The GBI’s involvement does not by itself establish any criminal charge or conclusion about the case. Doraville police remained the agency describing the homicide investigation in the reports reviewed Monday.

Formal charges against Roman-Cortez had not been publicly specified in the initial police information reviewed after the shooting. Authorities also had not released additional details about the evidence collected at the scene or whether investigators were seeking other people in connection with the case. Roman-Cortez has not been convicted of a crime in connection with the shooting.

Doraville police said the investigation remains active and asked people with information about the shooting to contact the department. Investigators had not announced a court date or other confirmed next legal proceeding for Roman-Cortez as of Monday morning.
